McDougall Smith’s Statement of Commitment
McDougall Smith Human Resources and Recruitment (McDougall Smith) acknowledges that it is bound by and will comply with the National Privacy Principles (NPP) and other requirements under the Privacy Act 1988 (Cth) (The Privacy Act). This Privacy/Collection Statement explains these principles and sets out McDougall Smith’s policy in relation to the use of personal information.
What is Personal Information?
Personal information is any information or an opinion about you that McDougall Smith has collected. It may range from sensitive (eg. medical history or condition) to everyday information (eg. address and telephone number). It would include the opinions of others about your work performance, your work experience and qualifications, aptitude test results, psychological tests, results and reports and other information obtained by us in connection with your actual or possible work placements.
What is Sensitive Information?
Sensitive Information is a subset of personal information. It includes information or an opinion about an individual’s:
- Racial or ethnic origin; or
- Political opinions; OR
- Membership of a political association; or
- Religious beliefs or affiliations; or
- Philosophical beliefs; or
- Membership of a professional or trade association; or
- Membership of a trade union; or
- Sexual preferences or practices; or
- Criminal record; or
- Health information about an individual.
Collection of Personal Information
McDougall Smith will collect your personal and sensitive information for its own use in connection with your application for registration. McDougall Smith may also collect personal and sensitive information from you when required in the ordinary course of operating as a Recruitment Agency.
How will your information be used?
Your personal and sensitive information may be used in connection with:
- Potential or actual work placements;
- Performance Feedback;
- Tests or Assessments that we may require you to undertake;
- Workplace Rehabilitation;
- Management of complaints, investigations or inquiries in which you are involved;
- Insurance Claims or proposals that require disclosure of your personal or sensitive information.
What happens if you do not provide the information requested?
If you do not provide the information that McDougall Smith requests, then we may be limited in our ability to locate suitable work for you or in our ability to place you in work.
Disclosure of your Personal Information
It may be necessary for McDougall Smith to disclose your personal and sensitive information to third parties such as:
- Clients of McDougall Smith which may be potential and actual employers;
- Referees;
- McDougall Smith’s Insurers;
- A professional Association or registration body that has a proper interest in the disclosure of your personal and sensitive information;
- Workers Compensation Body;
- Our contractors and suppliers for eg. information technology contractors and database designers
- Any person lawfully permitted to obtain the information.
Security of your Personal Information
Your personal information may be stored electronically or in hard copy. McDougall Smith will take reasonable steps to protect your personal information collected by McDougall Smith from misuse and loss and from unauthorised access, modification or disclosure.
Access to Information
McDougall Smith acknowledges that the Privacy Act and the NPP require that except in some limited circumstances, persons may access all their personal information and have the right to correct it, or at least attach a personal statement of correction. If you wish to exercise your rights of access and correction you should contact the Privacy Officer, whose details are shown below.
